Protect Your Parents’ House and Savings: A 16-Point Senior Rights Guide (California)

Protect Your Parents’ House and Savings: A 16-Point Senior Rights Guide (California)

4 min read

Not legal advice. This article is general information for California readers. For advice on your situation, talk to a licensed California attorney or one of the free programs listed below.

In 2025, Americans age 60 and older reported 201,266 fraud complaints to the FBI and lost about 7.75 billion dollars, a 59 percent jump in one year. The average loss was thirty-eight thousand five hundred dollars (FBI IC3 2025 report). Your parents’ house, savings and signature are targets. Here is a 16-point protection plan built only on public sources.

Part 1: Who can help with the paperwork

1. Legal document assistants type. They do not advise.

In California, a registered legal document assistant (LDA) may fill out forms at your specific direction, give you attorney-written general information, provide published forms, and file or serve papers you choose (Bus. & Prof. Code 6400).

2. They cannot pick your forms or your strategy

An LDA may not give “any kind of advice, explanation, opinion, or recommendation” about your rights, remedies, form selection or strategy (BPC 6400(g)). Anyone who charges must be registered with the county clerk (Mono County Clerk summary).

3. Check the registration, the bond and the contract

LDAs must register, post a bond, complete continuing education and use a standardized written contract (California Attorney General Opinion 22-602). No written contract means you walk away.

4. A paralegal works under a lawyer

A paralegal does substantive legal work only under a supervising attorney. An LDA works directly with self-represented people (San Luis Obispo County Clerk; BPC 6401).

5. The unauthorized practice of law is a crime

In California, giving legal advice without a license is a crime (State Bar of California). If a non-lawyer promises to “sue for you,” that is a red flag.

Part 2: Elder financial abuse and the law

6. What counts as financial abuse

Taking or keeping an elder’s property for a wrongful use, with intent to defraud, or through undue influence is financial abuse. This includes doing it through a trust, a will or a power of attorney (Welf. & Inst. Code 15610.30).

7. The abuser pays the legal bills

When financial abuse is proven, the court must award attorney fees and costs. You have four years from discovery to sue (WIC 15657.5 and 15657.7). This is why elder abuse lawyers take these cases.

8. Bad faith costs double

Someone who takes an elder’s property in bad faith can owe twice its value (Probate Code 859).

9. The scale is getting worse

Investment scams cost people over 60 about 3.5 billion dollars in 2025. Real-estate fraud drew 2,473 complaints (IC3).

Part 3: Protecting the house

10. Turn on the free Homeowner Alert today

LA County will email you whenever a deed, mortgage or foreclosure notice is recorded on your parcel. It takes about two minutes and costs nothing (LA County Assessor e-Notification).

11. Know the recorder’s mailed alerts

The Registrar-Recorder mails a notice within 30 days when a grant deed, quitclaim deed or deed of trust is recorded. If a recording looks suspicious, call DCBA at (800) 593-8222 (LA County DCBA).

12. Plan with documents, before a crisis

California has a statutory form for a financial power of attorney (Probate Code 4401). The courts’ self-help center explains wills, estates, trusts and advance planning (California Courts Self-Help). Planning early can mean conservatorship court is never needed.

Part 4: Fighting back, for free or cheaply

13. Small claims: up to twelve thousand five hundred dollars, no lawyer needed

Individuals can sue for up to twelve thousand five hundred dollars in small claims court. Lawyers can’t appear with you in court, so everyone stands on equal footing (California Courts).

14. Free legal help in Los Angeles

Bet Tzedek, (323) 939-0506, handles elder abuse, powers of attorney, wills, conservatorship and elder abuse restraining orders (Bet Tzedek). LA County’s Traditional Legal Assistance Program, (800) 510-2020, serves people 60 and older (LA County Aging & Disabilities). To report abuse, call Adult Protective Services at 1-877-477-3646 (APS).

Part 5: Rules for anyone serving seniors

15. Deceptive marketing to seniors costs triple

California bans deceptive sales practices (Civil Code 1770). When the victim is a senior, Civil Code 3345 allows penalties to be trebled (California Attorney General). Fear, false urgency and “act today” pitches have no place here.

16. Smart legal tools assist. They don’t replace a lawyer.

The State Bar’s guidance tells lawyers to verify every output, protect client confidentiality and keep human judgment in charge (State Bar practical guidance). The FTC charged one company for marketing its software as a “robot lawyer” (FTC complaint, DoNotPay). Software assistants are safe for checklists, deadline reminders, organizing receipts, watching recorder alerts and drafting a timeline for a lawyer. They are not safe for choosing your remedy.

The family checklist

  1. Sign up for the Homeowner Alert tonight.
  2. Put a power of attorney and an advance directive in place while everyone is healthy.
  3. Ask any document preparer for an LDA registration number and a written contract.
  4. Small debts go to small claims. Big thefts go to an elder abuse attorney or Bet Tzedek.
  5. Report abuse to APS: 1-877-477-3646.
